1. Agreement
These Terms of Use apply to every app and game made by Dylan Parker / QuSpace (“we”, “us”), including Quantum Snake 2, the Quantum Snake browser game, Overhead Flights, and any app we release in the future (each an “App”). By downloading, installing, or using an App you agree to these terms. If you got an App from Apple’s App Store or Google Play, that store’s terms also apply. Some Apps may have extra terms shown in the App or its store listing; those add to these terms.
2. License
We give you a personal, non-exclusive, non-transferable, revocable license to download and use the Apps on devices you own or control, for non-commercial use. We keep all rights in the Apps, their code, art, music, and names.
3. Acceptable Use
- Don’t copy, resell, redistribute, or modify the Apps, or reverse engineer them except where the law allows.
- Don’t cheat, exploit bugs, or manipulate leaderboards.
- Don’t use the Apps for anything unlawful or to harm others.
4. In-App Purchases
Some Apps offer optional in-app purchases. They are sold and processed by Apple (App Store) or Google (Google Play), and payment is charged to your Apple ID or Google Play account when you confirm the purchase. Prices are shown in the store before you buy. Use “Restore purchases” in the App, where offered, to restore a purchase on another device signed in to the same store account.
5. Auto-Renewing Subscriptions
Some Apps offer optional auto-renewing subscriptions. For example, Overhead Flights offers “Remove Ads” (product overhead_no_ads_yearly) for US$9.99 per year, or the local price shown in the store, which removes ads from the App.
- Billing: Subscriptions are billed by Apple or Google to your store account.
- Auto-renewal: A subscription renews automatically for another period at the then-current price unless you cancel or turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
- Managing or cancelling: Manage or cancel at any time in your store account settings: on iPhone or iPad, Settings › your name › Subscriptions; on Android, Play Store › Payments & subscriptions › Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you already paid for. Deleting an App does not cancel a subscription.
- Trials and price changes: If a free trial or introductory price is offered, any unused trial time ends when you buy a subscription. You will be told about price increases as the store requires, and you may cancel before they take effect.
6. Refunds
Refunds for purchases and subscriptions are handled by Apple or Google under their policies. Please request a refund through the store you bought from.
7. Ads
Some Apps may show ads from third-party ad networks. See our Privacy Policy for how ads and data are handled.
8. Third-Party Services and Data
Some Apps rely on third-party services or data (for example, flight data in Overhead Flights). We don’t control those services, and information from them may be delayed, incomplete, or unavailable.
9. No Warranty
The Apps are provided “as is” and “as available”, without warranties of any kind, to the extent permitted by law. We don’t promise they will be error-free or always available.
10. Limitation of Liability
To the extent permitted by law, we are not liable for any indirect, incidental, or consequential damages from using the Apps. Our total liability is limited to the amount you paid us for the relevant App or in-app purchases in the 12 months before the claim.
11. Apple Users
If you got an App from the App Store, Apple’s Standard Licensed Application End User License Agreement (EULA) also applies. Apple is not responsible for the Apps or their support.
12. Changes
We may update these terms. The new version will be posted on this page with a new date. Continuing to use the Apps means you accept the updated terms.
13. Governing Law
These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules.
